Zyper Cloud · Legal
Terms of Service
Effective October 6, 2026
By creating an account or using Zyper Cloud (the "Service"), you agree to these Terms with the Zyper Cloud team ("we", "us"). If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 and able to form a binding contract. You may not use the Service if you are in, or a resident of, a country or region subject to comprehensive sanctions, or if you are on any sanctions list. You are responsible for making sure your use is legal where you live.
2. What the Service does
The Service lets you schedule and automatically submit NFT mint transactions on supported blockchains and launchpads. It uses wallets created and managed for you, and it offers related tools such as distributions, consolidation, a Discord bot and notifications. Features, supported chains and supported launchpads may change at any time.
3. Accounts and security
- You are responsible for everything done through your account, including through linked wallets, passkeys and Discord.
- Keep your login methods, passkeys and devices secure. Tell us right away in #open-a-ticket in the Nimbus Discord if you suspect unauthorized access.
- One person per account. Do not share, sell or transfer accounts.
4. Custodial wallets
- When you use the Service, we generate wallets for you. We hold their private keys in encrypted form so the Service can sign transactions you schedule or request.
- You can export your private keys through the Service's security flow. After export, anyone who has the key can move the funds, and we cannot reverse that.
- You are responsible for funding your wallets and for the assets in them. Blockchain transactions are final. We cannot reverse, cancel or refund a transaction once it is broadcast.
- We do not provide banking, custody-trust, brokerage or money-transmission services. Wallet balances are not deposits and are not insured.
5. No guarantee of results
Minting is competitive and depends on systems we do not control: blockchains, gas markets, launchpads, allowlists, rate limits and other users. We do not guarantee that any mint will succeed, be fast enough, or cost a particular amount. A failed or late mint is not a breach of these Terms unless the Refund Policy says otherwise.
6. Third-party platforms
The Service interacts with third-party blockchains, launchpads, marketplaces and Discord. Their terms apply to you, and you are responsible for following them. We are not responsible for their availability, rules, fees, errors or decisions, including any decision to limit, block or ban you.
7. Discord sign-in and partner rewards
- Discord sign-in. You sign in with Discord. Your use of Discord is governed by Discord's Terms of Service and Community Guidelines. We read only what our Privacy Policy describes.
- Partner rewards. Some partners grant membership days to holders of specific roles in their Discord server. Rewards are set by us and the partner, may change or end at any time (including at the end of the free beta), are capped per day, and are not a purchase. Losing the role ends future rewards; days already granted are not removed unless obtained by fraud.
- No manipulation. You may not create or use multiple Discord or wallet accounts, or obtain roles improperly, to receive rewards more than once. We may remove rewards obtained this way and suspend the account.
- Server invites. If you choose Join Zyper, you authorize us to add your Discord account to the Zyper server once. We never add you to a server without that click.
8. Subscriptions and fees
- Some features require a paid membership. Prices and what each tier includes are shown in the Service before you pay.
- Memberships are prepaid in USDC for a fixed period and do not renew automatically. When a period ends, paid features stop until you pay again.
- Blockchain network fees (gas), launchpad mint prices and any third-party fees are paid from your wallets and are separate from membership fees.
- Refunds are covered only by the Refund Policy below.
- You are responsible for any taxes on your use of the Service and on your digital assets.
9. Acceptable use
You may not:
- Access the Service, its APIs or its Discord bot other than through the interfaces we provide, or use scripts, bots or other automation against them, unless we have agreed in writing.
- Reverse engineer, copy or reuse the Service's APIs, or build or operate a product that relies on them, or build a competing product using the Service.
- Share, resell or sublicense access, or run the Service on behalf of others.
- Get around membership limits, wallet caps, rate limits or any security control.
- Probe, scan or test the Service's security without our written permission.
- Use the Service for fraud, market manipulation, money laundering, sanctions evasion or anything illegal.
- Interfere with the Service or other users, or overload our systems.
We may investigate and take any action we consider appropriate against a breach, including suspension.
10. Suspension and termination
- We may suspend or end your access at any time if you breach these Terms, if required by law, or to protect the Service or other users. Where it is safe and lawful, we will tell you why.
- Access to your wallets for export or withdrawal remains available after termination for at least 30 days, unless the law requires otherwise.
- You may stop using the Service at any time. Membership fees for the current period are not refunded on cancellation, except as the Refund Policy says.
11. Not financial advice
Nothing in the Service is investment, financial, legal or tax advice. NFTs and digital assets are volatile and may become worthless. You decide what to mint and spend, and you accept those risks.
12. Intellectual property
The Service, its software, design and brand belong to us or our licensors. We give you a limited, personal, non-transferable, revocable license to use the Service under these Terms. NFTs you mint are governed by their creators' terms, not ours.
13. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted, error-free or secure against every attack.
14. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages. That includes lost profits, lost opportunities (such as a missed or failed mint) and lost or devalued digital assets. Our total liability for any claim relating to the Service is limited to the membership fees you paid us in the 3 months before the event that caused the claim.
15. Indemnity
You will defend and indemnify us against third-party claims that arise from your breach of these Terms, your violation of law or third-party terms, or your misuse of the Service.
16. Changes
We may update these Terms. If a change is material, we will give notice in the Service at least 14 days before it takes effect. Continuing to use the Service after that means you accept the change.
17. Contact
Questions, support and account requests: open a ticket in #open-a-ticket in the Nimbus Discord.
Refund Policy
Membership fees are non-refundable, except when our own fault stops the Service from doing what you paid for. In that case you get a service credit, or a pro-rata refund if you ask for one.
You are covered when:
- A scheduled mint did not fire, or fired late, because of a fault in our systems (an outage, a bug, or our infrastructure failing). You get a credit of 7 membership days per affected drop, up to the length of your current period.
- The Service was unavailable to you for more than 72 hours in total in one membership period, because of our systems. You get a pro-rata credit for the time lost, or a pro-rata refund on request.
- You were charged twice, or charged for a tier you did not receive. You get a full refund of the extra charge.
- We end the Service, or end your access without cause. You get a pro-rata refund of the unused period.
You are not covered for:
- A mint that fired correctly but lost to other buyers, sold out, or failed because of gas prices or network congestion.
- Launchpad, marketplace, blockchain or Discord outages, rule changes, rate limits or blocks.
- Allowlist or eligibility decisions made by a project or launchpad.
- Insufficient wallet funds, a wrong or changed configuration, or a cancelled schedule.
- Suspension or termination because you broke the Terms.
- Changes in the value of any NFT or digital asset.
- Gas, mint prices or third-party fees, which are paid on-chain and cannot be recalled.
How to ask: open a ticket in #open-a-ticket in the Nimbus Discord within 14 days of the problem, with your account, the drop or date, and what you expected to happen. We check our logs and reply within 5 business days. Credits are added to your current or next membership period. Refunds are paid in USDC to the wallet the payment came from, within 10 business days of approval, and are limited to the membership fees you paid for the affected period.
